Fiduciary Liability and Insurance: Understanding and Mitigating a Fiduciary’s Exposure

Do you help employees enroll in benefit plans? Do you have a role in plan selection or design? Do you hire an outside advisor to provide these services for you? If you answered “yes” to any of these questions, then you need to participate in this webinar, which will explore basic concepts of fiduciary liability, examine recent case law and insurance developments, and provide fiduciaries with the latest information to guard themselves against constantly evolving exposures. Highlights will include, among other things, a discussion of the fiduciary liability issues recently created by the Affordable Care Act, and the important insurance coverage distinction between “settlor” vs. “fiduciary” liability and how that distinction affects coverage under your policy.
